Who This Agreement Is Between
Lewdly is operated by [COMPANY LEGAL NAME], registered at [REGISTERED ADDRESS]. In this document we, us and our mean that company, and you means the person using the platform.
By creating an account or using any part of Lewdly you agree to these terms. If you do not agree to them, do not use the platform. If you are using Lewdly on behalf of an organisation, you confirm that you are allowed to bind that organisation.
You Must Be 18 or Over
Lewdly is an adult platform and is available only to people aged 18 or over. There is no younger tier and no supervised mode.
You may not use Lewdly if you are under 18, if you are below the age of majority where you live, or if adult material is unlawful in your country. Creating an account is a statement that you meet all three conditions. If we find that an account belongs to a minor we close it, and we do not refund it.
Do not let anyone else use your account, and do not leave a signed-in session where a minor can reach it. Our Underage Content Policy sets out the one rule on this platform that has no exceptions.
What Lewdly Provides
Lewdly generates images and video and hosts conversations with fictional AI characters. Everything it produces is machine generated. The characters are not real people, the conversations are not with a person, and nothing generated should be treated as a photograph or as a record of anything that happened.
The platform runs on a credit system. Generating consumes credits, the amount depending on what you generate, and your plan determines how many credits you receive and how often. We may change models, features and credit costs as the underlying technology changes.
Your Account
An account belongs to one person. You are responsible for keeping your credentials secure and for everything done through your account, whether or not you did it.
- Give accurate registration details and keep them current.
- Do not share, sell, rent or transfer your account or its credits.
- Tell us promptly if you think someone else has accessed your account.
- Do not create a new account to get around a suspension or termination.
What You May and May Not Do
Explicit content between adult fictional characters is the purpose of this platform and you will not be penalised for making it. The limits are narrow and they are about real people and real harm rather than about how explicit something is.
The full list is in our Acceptable Use Policy, and the plain-language version is in our Community Guidelines. Four things are prohibited absolutely, are not adjustable by any setting, and result in immediate termination.
- Any sexual or suggestive depiction of a minor, or of a character presented as a minor, in any style, at any claimed age, under any fictional premise.
- Sexual content depicting a real, identifiable person who has not consented, including anything made from an uploaded photograph of them.
- Content depicting non-consensual sexual activity as though it were real rather than as clearly fictional roleplay between adult characters.
- Content depicting real violence, real injury or real death.
Ownership of What You Generate
You own the output you generate on Lewdly, to the extent that generated output can be owned at all. Copyright in machine-generated material is unsettled in many countries and we cannot promise you a right that the law may not grant. What we can promise is that we do not claim ownership of it.
You give us the licence we need to run the service, which means storing your prompts and output, transmitting them to you, screening them for policy breaches, and keeping copies where the law requires it. That licence lasts as long as we hold the content and no longer. We do not use your private generations or conversations to train base models without your consent.
The platform itself stays ours. That includes the models, the interface, the characters we publish, the code and the brand. You may not copy it, reverse engineer it, or use output from it to train a competing model.
You are responsible for anything you upload as a reference. You must own it or have permission to use it, and it must not be a photograph of a person who has not agreed to what you are doing with it.
Credits, Billing and Renewal
Paid plans are subscriptions. They renew automatically at the end of each billing period at the published price until you cancel, and you can cancel at any time from your account.
Credits have no cash value, cannot be transferred between accounts, and are not property. On longer plans credits are released across the term rather than all at once.
Our Refund and Cancellation Policy sets out when a refund is available and when it is not. Read it before you buy, because most of the platform is consumed immediately on use and that affects what can be refunded.
Moderation, Suspension and Termination
We screen prompts before generation and output after it, and we review what those systems flag. We may remove content, refuse a generation, restrict features, suspend an account or terminate it.
For the four absolute prohibitions, termination is immediate and permanent. For everything else we would rather warn you first, and you can challenge a decision through our Complaint Policy. Automated moderation produces false positives and a blocked generation is not by itself evidence that you did anything wrong.
You can close your account at any time. When an account ends, for whatever reason, access stops, unused credits are forfeited, and we delete your content on the schedule in our Privacy Policy except where we are required to keep something.
The Service Is Provided As It Is
We do not promise that Lewdly will always be available, that it will be free of faults, or that any particular model or feature will keep existing. We do not promise that a generation will match what you had in mind. These models are probabilistic and two identical prompts can produce very different results, which is a property of the technology rather than a defect.
To the extent the law allows, we exclude all warranties that are not written in this document.
Limitation of Liability
We are not liable for indirect, incidental, special or consequential loss, for lost profits, or for lost data, however it arises.
Where we are liable, our total liability to you for all claims together is limited to the amount you actually paid us in the twelve months before the claim arose.
Nothing in this section removes liability that cannot lawfully be removed, including liability for death or personal injury caused by negligence, for fraud, and for any consumer rights you have that cannot be contracted out of.
Your Responsibility for Misuse
If someone brings a claim against us because of how you used Lewdly, because of something you generated or published, or because you broke these terms, you agree to cover our reasonable costs and losses in dealing with it. This does not apply to the extent the claim was our fault.
Changes to These Terms
We may change these terms. For material changes we will give notice by email or in the product before they take effect, and the date at the top of this page will change. If you keep using Lewdly after that, you accept the new version. If you do not want to, cancel and stop using the platform.
Governing Law and Disputes
These terms are governed by the law of [GOVERNING JURISDICTION], and the courts of [GOVERNING JURISDICTION] have jurisdiction over disputes arising from them.
If you are a consumer, this does not take away the protection of the mandatory consumer law of the country you live in, or your right to bring a claim in your local courts where that law gives you one.
Please raise a problem with us before escalating it. Most things are fixable through our Complaint Policy, and it is faster than anything else available to either of us.
