Exemption

All visual depictions appearing on or generated through Lewdly are exempt from the record-keeping requirements of 18 U.S.C. 2257 and 28 C.F.R. Part 75.

The exemption applies because the content does not portray actual human beings engaged in actual or simulated sexually explicit conduct. Every image and video available on or produced by this platform is generated by machine learning models. No photographic or video recording of a real person is used as the subject of generated output, and no real performers are involved in its production.

What This Means in Practice

Characters on Lewdly are fictional. They have no real-world counterpart, they are not derived from photographs of identifiable individuals, and they are not representations of any living or deceased person.

Because no performers exist, there are no performer records to maintain, and no age-verification records for performers can meaningfully be produced.

Depictions of Real People Are Prohibited

Generating sexual content depicting a real, identifiable person without their consent is prohibited by our terms and is enforced. This includes uploading a photograph of a real person for the purpose of producing sexual imagery of them.
